2019 Markoff's Haunted Forest Waiver & Release of Claims
WAIVER: In consideration of CALLEVA INC, furnishing services and/or equipment to enable me to participate in registered Markoffs Haunted Forest (MHF) & ASSOCIATED ACTIVITIES, I agree as follows:
I fully understand and acknowledge that: (a) risks and dangers exist in my use of equipment and my participation in registered MHF & ASSOCIATED ACTIVITIES, (b) my participation in such activities and/or use of such equipment may result in my illness including but not limited to bodily injury, emotional distraught, disease, strains, fractures, partial and/or total paralysis, eye injury, blindness, heat stroke, heart attack, death or other ailments that could cause serious disability; (c) these risks and danger may be caused by negligence of the participants, negligence of others, accidents, breeches of contract, environmental surrounds (natural & artificial) added obstacles, forces of nature or other causes; (d) activities may include participation on private property not affiliated/owned by Calleva, in return for being allowed to enter and use these properties, I give up the legal right to sue property owner(s) if I get injured or killed while I am there. These risks and dangers may arise from foreseeable or unforeseeable causes.
I, on behalf of myself, personal representative, and my heirs, hereby voluntarily agree to release, waiver, discharge, hold harmless, defend and indemnify its owners, agents, officers, property owners, and employees from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services, or otherwise which may arise out of my participation in MHF& ASSOCIATED ACTIVITIES or the use of equipment required for participation. I specifically understand that I am releasing, discharging and waving any claims or actions that have presently or in the future for accidents beyond the control of CALLEVA INC & MARKOFFS HAUNTED FOREST.
RISKS: The MHF is meant to scare and terrify, and assumes no responsibility to how you or others react to such scares. Participants should expect physical contact while attending any of these activities. If you are pregnant, have a heart condition, pre-existing health restraints, or intolerance to strobes and lights that may trigger epileptic seizures; then this is not for you. In addition; the trail, bridges, tunnels and/or walkways are uneven and poorly lit with many obstacles and structures that are hazardous. You assume all risks and responsibilities upon stepping foot on our property and waive the MHF, Calleva Inc., and all property owners, of any and all responsibilities, including and not limited to permanent impairment and/or death.
HEALTH STATEMENT: These activities involve participation in outdoor activities that are, by their nature, physically and mentally demanding. Therefore all participants must be free of medical or physical conditions, which might create undue risk to themselves or to others who depend on them. If there is any doubt whatsoever about your ability to safely participate in this activity, you should have a physical examination by a physician. I declare that I am in good physical health and believe that I am able without reservations or limited conditions to physically withstand and cope with the indicated rigors of this activity.
RELEASE OF LIABILITY: Photo Release: We hereby authorize and give full consent to Calleva, Inc & MHF to copyright or publish all photographs, video or images for appropriate promotional material related to the activity.
BY CHOOSING TO PATRONIZE THE MARKOFF'S HAUNTED FOREST, YOU AGREE THAT: 1) You have read and understood the above statement and agree to assume any and all risks associated with your decision to patronize the Haunted Forest. 2) You agree to release Markoff's Haunted Forest, Calleva Inc., and their directors, owners, employees, and property owners of liability for any injuries or other harm that you or your minor child(ren) may suffer at Markoff's Haunted Forest. 3) You declare that you are in good physical health and believe that you are able without reservations or limited conditions to physically withstand and cope with the rigors of these activities.
The Markoff's Haunted Forest is intended for your enjoyment, but can be extremely dangerous. By participating in the MHF and associated activities, YOU ASSUME ALL RISKS and HAZARDS associated with this event.
